Not happening any time soon. In addition to Sony (via its purchase of MGM), Time Warner, and other companies splitting the rights to a movie adaptation of "The Hobbit", Peter Jackson has just sued New Line concerning the profits from "LOTR 1".

"Film-maker Peter Jackson's production company has sued New Line Cinema over profits from the first film in the Lord Of The Rings trilogy. Wingnut Films alleges in a federal lawsuit filed on Monday in Los Angeles that New Line and subsidiary Katja Motion Pictures failed to properly calculate revenue - including money from DVD sales - from 2001's The Lord Of The Rings: The Fellowship Of The Ring. The lawsuit doesn't give a specific amount sought in damages but claims the movie grossed more than $314 million in box office receipts in the United States and more than $556 million overseas, plus revenue from video and merchandise sales. The lawsuit accuses the studio of giving affiliates favorable licensing deals. It seeks a court injunction against New Line from reaching deals related to the film with affiliates "without first seeking the most competitive and beneficial deals from unaffiliated third parties in a free and open market"."

It's not Pete raising the law suit (well, perhaps it is, although it says his production company, so one of his fellow employee's probably noticed it or something, it doesn't really matter I suppose) and honestly: what would you do in that situation? I personally would go for the jugular. He worked very hard on this project and deserves all the money he can get, or at least as much as he's willing to fight for. I say kudos to Pete for not letting stuff slide.
Does Pete have to direct the Hobbit? It would be preferable, sure, but from the looks of it I doubt if New Line will be too happy to work with him any time soon, perhaps a new director is in order...

Oh I dont mind him going for his money. your right he does deserve all that he cna get, I am just bummed about it making the Hobbit lag even MORE!
