See Tony, it's all coming together now, for a Blu-ray world!
But is that company's use of the word "Blu-ray" legal?
Maybe the whole thing's a joke.

Lindsay Lohan should have used that before doing the Blu-ray movie "I Know Who Killed Me".

Well, I have seen trade names and bizz names coexist. I worked in the sign industry for about five years and it's amazing how many companys have similar or same names. For example, Gerber makes baby food and infant products, but there is also a Gerber that makes plotter software for the sign and design industry -- complete two different companys. Living in Arizona, we have Fry's Electronics but we also have Fry's Grocery -- again, two complete different companys. I remember when Fry's Electronics moved into town and I had the pleasure of doing their sign-design work. Our company sales guy told me the two-Fry's companys went through a legality session with attorneys. The outcome was that both companys looked at it as free advertizing and droped the entire issue. Sounds strange, but yeah, that's what happened.

Well if it's trade mark infringement than the BDA has a case because they definitely used the words HIgh Definition.

I should have pointed this out in my last post since I work in the design industry, duh!
He's right, there is no violation since TM is considered for the style (logo) in which it is created. For TM it's all about the letter style, icon, etc. Now if it was a copyright, then it would be a different story since a copyright is for the actual word.

Kodak also uses the term 'High Definition' in their exposure films & some digicamera products.
I don't think anyone has a patent over that term, unlike Sony's patented "Resistance 2", or Jobs' "Ipod.... or NFL's "Superbowl".

Yeah, STARBUCKS either sues (or threatens to sue) any similar sounding, looking, copycat to their name. I bet that cosmetic company gets into trouble with the BRDA.
(or, perhaps they already have a license to use it?)

Yes, it would have to be since the company is Cargo -- therefore the product is blu_ray. I would have no doubt that Cargo probably has already had negociations with the BDA since the site's copyright is 2008, meaning it's a very new site.
Neverthelss, no violation as you can see Cargo uses the Handel Gothic font, all letters lowercase and an underscore. The BDA uses a custom font with first letter uppercase and a hyphen. So there you have it, no harm done.

xplaytendo,
My point is that if you use the Blu ray name inconjuction with the words high definition together, I would think that's a problem. I remember some years back when there was a restraunt named SONY. SONY the company took the owner to court saying that the name SONY is unique and this was name infringement. The owner said that this was his name and he was entitled to use it. In the end SONY won. Maybe because they had better lawyers.

Then again, maybe the BDA actually paid this cosmetics line to adopt the name!

Agreed, and this actually goes back to what I said about how two companys look at it as free advertizing.

Maybe the next gen. Blu players will have a little pop-out mascara compartment and fold out mirror? I wonder if "Tampax" is next?
