Well, I have seen trade names and bizz names coexist. I worked in the sign industry for about five years and it's amazing how many companys have similar or same names. For example, Gerber makes baby food and infant products, but there is also a Gerber that makes plotter software for the sign and design industry -- complete two different companys. Living in Arizona, we have Fry's Electronics but we also have Fry's Grocery -- again, two complete different companys. I remember when Fry's Electronics moved into town and I had the pleasure of doing their sign-design work. Our company sales guy told me the two-Fry's companys went through a legality session with attorneys. The outcome was that both companys looked at it as free advertizing and droped the entire issue. Sounds strange, but yeah, that's what happened.

Well if it's trade mark infringement than the BDA has a case because they definitely used the words HIgh Definition.

I should have pointed this out in my last post since I work in the design industry, duh!

He's right, there is no violation since TM is considered for the style (logo) in which it is created. For TM it's all about the letter style, icon, etc. Now if it was a copyright, then it would be a different story since a copyright is for the actual word.

Yea but Tim, could it be that the TM is for the cosmetic product line it's self? If not I see a lawsiut in
T-minus 10,9,8.....
